Botox Defense

There was a woman in Vancouver who has been fortunate enough to have the charge of refusing to take a Breathalyzer test thrown out of court. She explained to the judge that she was incapable of blowing into the screening device, as her face had been paralyzed by having Botox injections. She used the Botox explanation when representing herself during her trial on a charge of refusing to take a Breathalyzer test. She had been pulled over after midnight, April 24th and had been requested to take a Breathalyzer test. Having been given multiple chances to blow into the device, but the mechanism failed to register each time.

The woman explained in court that she couldn’t get her lips to form the proper shape to blow into the device because of Botox treatments she had received beforehand. Her Mexican doctor wrote a letter that stated that “when an individual undergoes Botox treatments, their upper lip and mouth area are affected so that they are unable to purse their lips or whistle.” This can last for up to six months and it is very common for Botox patients to be unable to use a straw or wrap their lips around a Breathalyzer device.

A Botox procedure is an injection that inhibits wrinkles by partially paralyzing the facial muscles, and the judge agreed to dismiss the charge for a month. Police have never heard of Botox being used in a defense against drunk driving charges, and they find the excuse very hard to believe.

Nevertheless, it is presumed that claiming to have undergone Botox treatments may be used as excuses in more drunk driving charges in the future. It is one of the most unusual defenses to have been presented to date, and such defenses may actually be legitimate, provided that other women that refuse to submit to a Breathalyzer test have indeed received Botox treatments before being asked to take said test. While there have been interesting excuses brought up as defense in different court cases in the past, this is one of the most unique to have been used to date.

Botox Has Many Uses

The Food and Drug Administration has recently approved Botox to help treat chronic migraines. This raises the question about what other conditions Botox, also know as the freezing fluid, is being or could possibly be used for. Off label use of medicines is very common, but it is more common when it comes to Botox. It has become an option to treat some cases of leaky bladders, excessive sweating, gummy smiles and involuntary ticking or winking.

Dr. Craig A. Vander Kolk is a plastic and reconstructive surgeon at Mercy Medical Center in Baltimore. He claims to have recently treated a brass instrument player who received an injury while playing the horn. Vander Kolk commonly uses Botox to treat what is know as trumpet-lip. He sees people from around the country from all the major orchestras for this same condition. “It does things to smooth muscles that help many conditions. It has so many different uses that it has changed things a lot for people”. “It’s helpful for many different conditions”, says Vander Kolk.

Dr. Joseph Eviatar is a board-certified oculofacial plastic surgeon and ophthamologist; he is also the medical director of Chelsea Eye and Plastic Surgery Associates. Eviatar claims that Botox can redo a ‘gummy smile’. “The vast majority of people have no idea they can get rid of a horsey smile by dropping their upper lip a little.”

“It is also useful to treat people who have had a stroke”, says Dr. Noah Rosen. Rosen is a neurologist at the North Shore University Hospital and also uses Botox to treat involuntary tics and movements such as involuntary winking.

Dr. Peter McAllister has used Botox to treat bladder spasms and says “It can also be used to treat excessive sweating. McAllister is a neurologist in Fairfield, Connecticut and a clinical assistant professor of neurology at Yale University School of Medicine.

Vander Kolk says, “You can’t quite call it a miracle drug, but it’s an amazing medication.” Other doctors are beginning to agree with him about the many possibilities that Botox could have for patients with all sorts of different conditions.

Teenage Botox and Plastic Surgery Rising

With so many adults now a days using cosmetic surgery to change themselves, teens are now looking to use cosmetic surgery as well. This is a huge societal problem.

This is what many doctors and medical professionals are now seeing in many of the cosmetic surgery clinics and botox offices. Teenagers, some as young as 13 years old, are already have procedures done to remove and reduce facial lines and and wrinkles. By 2009 there were 12,000 botox injections completed on children that were between the ages of 13 and 19.

Botox has advantages when it comes to the cost of the procedure. Botox is around £200 for the injections, compared to 1,000′s of pounds for plastic surgery treatments.

One reason there has been an increase in plastic surgery and botox injections in teens may be due to prominent figures that are in media, as well as older actors and actresses that are having these treatments done. Many of these people opt for these procedures to be able to compete with their younger counter parts for movie roles and TV spots.

Laser Hair Removal Increasing This Summer

Preferred Facial Treatments and Procedures

Leading Plastic Surgeon urges the MHRA to clarify its stance on whether Nurses can administer Botox and if it can be mentioned on websites.

Mr Adrian Richards, Clinical Director of Cosmetic Courses has called for the Government controlled MHRA to clarify it stance on two major issues.  Are Nurses allowed to administer Botox injections without the patient seeing a doctor or dentist and whether the term Botox can be used on websites?   Mr Richards stated that because the MHRA recommendations are not being enforced they are being widely ignored throughout the UK.

The MHRA- Medicines and Healthcare regulatory Agency is the government body “designed to ensure that Medicines and Medical devices are acceptably safe”.  As such it regulates the use of all prescription only (POM’s) including Botox.

The MHRA’s guidelines state that Botox “can be administered by an appropriate practitioner or under the guidance of an appropriate practitioner”.  By this they mean a Doctor, Dentist or Nurse who has completed extra training to allow them to prescribe Botox.

Mr Richards however feels that the MHRA phrase “under the guidance of an appropriate practitioner” is unnecessarily woollen and can be interpreted in many different ways.

The Nursing and Midwifery Council (NMC) have stated that they do not consider it good practice for nurses to administer Botox via a remote consultation.  They recommend that each patient is reviewed in person by a Doctor or Dentist prior to treatment.

This is not specifically stated as a recommendation by the MHRA.  This has resulted in some Nurses abiding by the NMC recommendations but many ignoring them completely and administering Botox injections with no contact with an “Appropriate practitioner”

Mr Richards stated that the MHRA guidelines are being widely ignored with impunity because no Nurse has yet been prosecuted by the MHRA for repeatedly ignoring their recommendations.

Likewise advertising prescription only medicines such as Botox is illegal.  However many websites feature Botox heavily on their home pages.  The MHRA’s role is to enforce this but again Mr Richards said that these companies were ignoring the recommendations because the MHRA have never taken any legal action against them.

Mr Richards urged the MHRA to clarify both of these issues as soon as possible to ensure that Botox treatments are as safe as possible and administered by appropriate practitioners.

I would recommend watching Botox training2: Where to Place Botox injections as a lead video. It starts with a clear introduction about what the video is about, shows a detailed medical understanding (also suitable for lamens) and puts the viewers mind at rest. I had never seen a botox video before, but felt relaxed as the patient seemed to be very happy to receive treatment and very much in control and she wasn’t tied to a chair or suffering too much pain…i am a little squeamish you know.

So lets start gently with a video that shows the muscle structure of the face and which muscles can be targeted with Botox.
